Yes, as long as the applicant obtains a commercial driver’s license (CDL) before the renewed commercial learner’s permit (CLP) expires.
The rule did not specify that the commercial learner’s permit (CLP) had to be renewed before the compliance date; only that the driver must obtain a commercial driver’s license (CDL) or endorsement before the renewed CLP expires. If the State Driver’s License Agency (SDLA) renews the CLP under this scenario, the driver is in compliance if he/she gets a CDL before the renewed CLP expires.
No, the applicant would not be grandfathered because he/she did not obtain a commercial driver’s license (CDL) before the initial commercial learner’s permit (CLP), issued before the compliance date expired. This scenario would not be considered a renewal, so the applicant must start over. In other words, under current regulations, no State Driver’s License Agency (SDLA) has the option to “renew” a CLP if one year has passed since the CLP was initially issued. The applicant would be treated as though he/she were initially obtaining a CLP after the compliance date and therefore subject to the entry-level driver training (ELDT) requirements.
